  • Advance Parole.

    Hi everybody... i have a question about the Advance Parole.
    I am from Italy, married with an American citizen since Oct.20th 2006.. i just decided to try to move here, and actually we should send all the documents to the USCIS tomorrow... i know that for being able to travel out of the coutry, before the 2 years of marriage i need to apply for the Advance Parole... now, how does it work?what do i need?... and is it an "easy process"???

    To be able to travel you have to file form I-131. Make sure you send it to the right Immigration Office and that you fill everything correctly with ALL the documentation they need. It normally takes 2 months. But if you mess up like I did it can take much much longer.

    12/29/2006: RD and priority date
    01/03/2006: Request for evidence regarding I-131
    01/16/2007: Biometrics for I-131 and I-485
    01/22/2006: New RD for I-131
    03/18/2007: I-756 approved
    03/23/2007: Received work permit
    06/14/2007: Interview scheduled

      Hi salvador just wanted to double check with you. Did u receive a priority date on the notice of receipts (I130, I485, I765) from uscis. Also when did you receive your interview letter. Am asking as my i am married to a USC but my notices from USCIS does not have any priority date nor have i receive a interview date. Good luck on your upcoming interview

        You may not need to file I-131

        Hi Katia

        You only need to file an I-131 Advance parole if you will want to leave the country while your I-130 and I-485 are being considered. I just went through the process of Adjustment of Status here in Southern California and the whole process from filing the documents until receiving approval took about 90 days. So assuming you do not need to leave the US during the next 90-120 days then you can avoid the expense of filing the I-131. The main reason you need an I-131 is so that the USCIS doesn't assume your applications for the I-130 and I-485 are abandoned if you decide to travel outside the country before they provide their decision on the I-130 and I-485.

          I forgot to mention that once the USCIS approves your I-130 and I-485 and you have received your green card, you can use the green card when you want to travel out of the country. I don't think you need an I-131 if you have a conditional green card (one that they give you if you have been married for less than 2 years when they approve).

          So as I said previously, if you don't think you'll need to travel in the next 3-4 months before your I-130 and I-485 are considered, then you can avoid the I-131 filing. Once you get approval, the green card will allow you to leave the US and travel back to Italy whenever you want.

            Just to be clear, once my I-485 and I-130 are approved, and i get everything, even if i am not married for 2 years, i can leave the country, without the I-131?? i dont need anything else, but the green card???

              It's funny because none of my receipt notices had any priority date and I was starting to be worried when I heard people talk about it. Now, on the letter scheduling the interview (which I received on April 24th) they finally put it there. What is the received date of your I-485?

                My receipts dates are March 2, 2007. Biometrics March 29. Nothing since then.

                  Then, on your interview letter they will probably use that same date (March 2nd) as your priority date.
