My wife and I have an expired H4 and H1-B stamp respectively on our passport but are working on H1-B (I-797) valid until 10/31/2009 (for my wife) and 04/21/2008 (for me).
Since the I-485 became current yesterday our companies will be filing the I-485 in the next few days. Before this news of I-485 becoming current came through we had already booked our travel to Europe and India starting middle of September to middle of October for this year. We were initially thinking of getting the H1-B visa stamp done in India to re-enter.
Now, since we are about to file I-485 in the next few days, I am sure we don't have enough time to get an approved advanced parole document that takes 4-5months to obtain.
Can we still travel and get a valid H1-B done in India to re-enter? Would there be a problem with the US consulate to issue a H1-B stamp since we would have already applied for the I-485? Also, would there be a problem with obtaining Schingen visa for Europe as well?
Please let me know. We may have to cancel our trip...Thanks for your help!!
