I-485 related questions

I have applied for my I-140 and am waiting on approval and now I want to apply for I-485. With respect to that application, I had a few questions.

1. Can I apply for I-485 while I-140 is still in the processing state.
2. I am planning to get married later in the year and my spouse is from India. Can I add her to my I-485 even though she is India? Given the uniqueness of the situation with AOS date being current what would you recommend the best thing to do right now.
3. can i add my spouse's name in my i-485 application if we get the registered marriage done in India and then i go back later in the year to get married the traditional way?

What would be the right thing to do given that this AOS being current might not last in FY-2008?

1. Yes it is called concurrent filing.
2. You will be able to add her only if the dates remain current then and your I-485 is approved

3. My advice get someone to file for court documents(u need 30 day notice) or go home right now and get married in a temple and the register the marriage.( This can be done right away). File H4 for ur wife and bring her and file for I-485 (she has to be here for I-485). She will have to stay in the country till she gets her Advanced Parole though. Same with you if you plan to follow this don't file I-485 before you leave but file together. And i hope you can grease some hands to get the certificate etc quickly or have enough clout to deal with things there.

And you need to file for her I-485 before July 30 ( though if the dates remain crrent in the next bulletin you will have an extra month.

It seems a hassle but anything else will delay her arrival or your GC for several years. An poerful argument to convince the elders of ur family.

Thanks for your suggestion. I was under the impression that the dates will be current until the end of september i.e. until the end of fiscal year 2007. It's mentioned in the visa bulletin that the dates will be severely retrogressed starting fiscal year 2008. So, is it safe to assume that these dates will be current until September.

the only safe period I know or sure is till 30th of July. anything else is your call.
