EAD Renewal

Hi,

I had applied for GC as spouse of American citizen in June 2006. I had my interview in beginning of Oct 2006 and my GC is not yet approved due to "pending security clearance".

Meanwhile, my EAD is expiring on Aug 31 2007 and I had applied for my EAD renewal in mid April. I have also completed my Biometrics appointment in May and I am now just waiting for EAD to arrive any time. I had received a letter from Immigration in end of April that my case has been transferred to California for faster processing but I really don't know what they mean by faster processing as its almost 3 months since I applied for renewal. I did notice that California center is processing I765 applications received as of April 28 2007 which means that my application must be getting processed. But as of now, its still pending when I saw the case status.

So the question is : Can I continue to work when I wait for my EAD as I have already applied for my EAD ?

you can work till Aug 31st but if the EAD does not come till then you will have to stop working.

EAD Renewal

I saw another reply from one of the discussion forums saying that its Ok to work as I filed well before the stipulated time and since we are not responsible for the delay in INS processing. Please advice !

no you have to have valid EAD to work. so you can work till expiry date. That is the reason they want you to apply six months in advance of the expiry date.

You should set up an infopass appointment to follow up on your case.

Thanks a lot. I guess I missed the 6 months period. I did apply 4.5 months ahead but it looks like that's not enough. I did talk to one of the lawyers I know and he also adviced to schedule a Infopass appointment and I have already scheduled one. Thanks a lot for your help !
