  • Interim EAD

I heard from one of the lawyers I know that the local INS office have stopped issuing "Interim EAD" from last year due to security concerns.

According to the lawyer "However, the local CIS offices were stripped of their ability to actually manufacture an interim EAD from last year. They can't do that anymore. Rather, they now only have the authority to question the Service Centers.".

Is this true ? If yes, why does 765 application still talks about "Interim EAD". I was planning to go to local INS office since my application to renew my EAD was filed 90 days before but now, the lawyer's response does not console me.

I just went to the local uscis for this morning. The lady told me since last OCT 16 2006. The local uscis does not accept any interim card application. But she did write a email to my application center to expedite my application's process.

        Dear "Password":

If you don't mind, can you please tell me if its been more than 90 days since you filed your 765 application. In my case, its been more than 90 days. I am meeting the local USCIS on Wednesday.

I think that we should ask the USCIS officers why the 765 application talks about "interim EAD" and gives a wrong information to the applicants.

Also, did they tell you where your case is stuck ? My attorney was saying that in rare cases, 765 can get stuck in "namecheck"(rarely ofcourse).

        Thanks in advance!

USCIS counts the 90 days on the day they receive

but when i call the national USCIS they told me to just go in your local USCIS even if i dun have my 90 days up yet .

and i guess the local USCIS mistaken my application date and the USCIS received date so they expidite my case for me. ( good mistake)

when u go in to the local USCIS , they will give u a paper saying tat they already discontinues the issuances of employment cards which is the "Interim card". And there is nothing they can do besides emailing your processing center.

and they did not tell me why my case is stuck,
but the USCIS did told me over the phone tat the california center`s computer was crush months ago so everything is delay. You can also check the processing date online. After you enter your receipt number.

And oh yeh!! try to make your appointment as early as possible or else you will end up waiting forever.

i hope i answer ur question
