  • concurrent I-140/I-485 - EAD and AP processing time

    I am concurrently filing for I-140 and I-485. Since my spouse is on F1, we are applying for EAD and AP too. We have travel plans in Feb 2008. How long would it take for processing for EAD and AP? Since I am concurrently filing for I-140/I-485, would EAD and AP be processed only after I-140 is approved?

    Hi,

    I have a question...will ur spouse continue to be on F1 once u file i140/485 concurrently?

    I sent my documents for conversion from H4 to F1 in May...the change of status is due anytime now. My main reason for filing was bcoz I was getting an assistantship from the college. My husband's employer wants to file i140/485 before aug 16 for both of us. I beleive that I will lose my F1 status if this filing is done and hence my assistantship too.

    Can anyone advice me on this?

        normally you do not lose a status if you apply for COS. In case of F1 you will continue to be F1 till you leave the country. Since with AOS pending you cannot reenter using F1 you will have to use AP.

        You do lose F1 status once you use EAD for work, which you should in your case.

        Remember you are not in F1 status till you actually get the approval.

          EAD/Ap are not dependent on I-140 approval. But with USCIS overwhelmed by applications timeline for approval is up for speculation. I would not make any firm plans yet and wait till Oct to get a better handle on the processing time.
