    My I-94 expired last January 10, but an H1-B petition was filed before that. Unfortunaltely, the H1-B was denied last April, which retroactively made me Out of Status since the petition was denied. Fortunately, an I-140 petition was filed by an employer last June, and an EAD application and an Adjustment of status were filed at that same time. Thank God the I-140 was approved and I have now an interim EAD! All I am waiting for is the Adjustment Of Status to Permanent Resident(Green Card)!!!

    So I was out of status for less than 180 days before I filed for the I-140, EAD and AOS. (January- June)

    My Question is, I want to go to Canada! I have applied for Advanced Parole! Will I have trouble coming back? I'm afraid I might be banned!

    I have a pending Adjustment of Status, I have an approved I-140 immigrant Petition, I have a newly acquired EAD, and have applied for Advanced Parole.

    Anyone please help! I need to go to Canada! But I wanna return back! Anyone in a similar situation?

    wihtout AP you cannot come back

    Hey,
    don't do any mistake. Approved I140 is not useful at border. You must have Advance payroll, letter from employer about your leave approva while you travelling plus keep you other documents ready with you while entereing in USA like your house rent receip, utility and bank statement, property papers if any which will prove that you are residing in USA and just travel outside USA for few days. Don't buy anything from canada (duty free etc).
