  • H4 / AP - Question

    Hello all,

I have heard so many different versions I am thoroughly confused. Hope someone will be able to throw some light:

We have a valid H1/H4 approval but no stamping on the passport. We have recently applied for AOS/EAD/AP.

    1. Can we travel to India before we recv the AP and get H1/H4 stamping there?

    2. Incase H1/H4 is denied in India for whatever reason can we travel on AP even if we got our AP approved while we are visiting India?

    3. Even if we recv AP before going to India can we go for H1/H4 stamping in India?

    Thanks for your replies.

    1. Can we travel to India before we recv the AP and get H1/H4 stamping there?

Ans: Yes. But carry all the supporting documents required for H-1/H-4 stamping.

    2. Incase H1/H4 is denied in India for whatever reason can we travel on AP even if we got our AP approved while we are visiting India?

Ans: Yes. You can travel. Carry all the ORIGINAL INS-receipts of I-485, EAD for all the members of your family.

    3. Even if we recv AP before going to India can we go for H1/H4 stamping in India?

Ans: Yes. You can go for stamping peacefully.

I am in the same situation. Would you please tell me,

By having the AP, and coming back from India - whether it is needed to go and get the Stamping done in India at the US Consulate - even we have our AP.

      Thanks a lot.

If you have Advance parole, there is no need of going to US consulate for visa stamping. But carry all the 485 original receipts with you. You should carry a transit visa for the country(s) you are travelling before you reach USA. Ex. If you are going and coming to US through London you should have UK transit VISA before you leave US. Transit VISA is required for all the countries.

                Thanks for the Information

                Hi dvkrao,
                Thanks for your help.
I called my Airlines and they sais I don't need transit visa if I am at the airport less than 72 hours and leaving for another country.
