Travel on H1 or Advance Parole(AP)?

Hello everyone,

I am on H1B visa and which is valid till May/2008 and about to file for AP.
I am not sure as what is the best decision if I plan to travel India in Dec'07/Jan'8 time frame.

Would it be advisable to not file AP and travel on H1B because there is guarantee of getting AP before Dec'07/Jan'08

OR

Its safe to travel on AP and I would get my AP before Dec'07/Jan'08, if I file in 1st week of Sept'07?


Please, advise me.

Advance Parole:Filing Problem +H4 OR ADVANCE PAROLE

Hi Everyone

My case is also the same as described below that I Just received my I-485 receipt and present status is H1 and valid up to the August 2008 and planning to visit India in Jan 08,My stamping is expired IN 2005.My wife has H4 stamping till August 2008 and she will travel with me so she also need to apply for Advance parole as I will do or she can travel on H4 and me on Advance parole.Please advise for such type of situation.

Second advise need for Filing application that I found one problem in I-131 that what should I write in "PRESENT STATUS"Shall I write H1 or Status adjustment.Please advise.

If I will file online ,is this decession is ok.What paper we need to send when we apply online.

I would appreciate your help.
