    Hi,
    My wife had applied for adjustment of status. She received her I-485, I-765, I-131 receipts etc...
    She had also received her EAD card. But she left the country without the Advance Parole. The approved Advance parole came just days after she left the country. I mailed her the approved Advance parole which is valid for a year. Will She have a problem entering the U.S using the Advance Parole.

    She will not have any problem entering US.

    If she had been on non-immigrant visa and if that visa is still valid, she can just enter on that NIV and no need to use Advanced Parole.

        Advance parole

        I have a question,

        I got married to my American born girlfriend
        I'm just sending in the papers to INS now and want to file for advanced parole too, but somebody told me that I have to wait until I get my work permit first then I can file.
        Is that true?

        I'm suposed to shoot a movie in europe in August do you think I will be able to do that?

          Dan,
          Once you have a I-485 pending, you MUST have AP to travel or else your AOS application will be deemed to hav ebeen withdrawn on your departure. Also, if you had overstaued more than 180 days before you filed for AOS, the AP will still be approved but you would not be wise to use it and try and reenter. You dont have to wait for EAD but can do aproabably as soon as you get your receipt notice for the other applications.

            If you overstayed your visa DO NOT FILE FOR ADVANCED PAROLE. My wife is from Canada and they are now going to deport her and ban her for 10 years for that very reason.
