  • Can I travel on my AP when I am still on H1-B?

    Hi,

Since Mar2000 I have been on H1-B (valid till Mar2003), but don't have this new visa stamped on my passport. I have applied for I485 and recently received my EAD. My green card process is through a self-petition (National Interest Waiver) and has nothing to do with my current employer. I am planning to apply for Advance Parole (AP). I have a few questions regarding my situation and any suggestions will be deeply appreciated. I am just evaluating my options, so the questions may seem a little disconnected.

    1) Can I travel and reenter US using AP while I am still on H1-B? or do I have to shift form H1-B to EAD status if I intend to use AP for traveling in and out of US?

    2) Is there an advantage to change from H1-B to EAD status, assuming I don't want to seek another job?

    3) If I seek another part-time job, do I have to contact the HR of my current full-time job and ask them to move me to EAD status as well?

Thanks a lot for your time!
