This question has been posted in different ways. But I have a
somewhat unique situation and I would like your opinion on how
I should proceed.
I just got my I-140 approved. I want to proceed with AOS. I
am getting married in November in India. So I will have to travel
abroad in November. And my wife will be here on a H-4.
1. Can I go ahead and apply for AOS right now and add my spouse's
name later on when I get back in December ?
2. If I apply for AOS right now, can I travel to India on my H-1 and
get back on H-1 ? I mean do I need an approved AP to travel or is
my H-1 just fine to travel ?
3. I read somewhere that I would need an I-485 receipt in the worst
case to get back . Since I am traveling in early November, what if I do
not get the I-485 receipt by then ? Is there a way around this ?
