  • H1 status to EAD

    Hi all,

    Need help. I'm in H1b currently filed GC with my spouse and got my ead. My spouse is primary. My question is does my status changes to ead automatically or how should i change my status? Is there any process for that? I'm currently working for a company in H1 and can i swift to another company with ead? or should i change my status first and then join the company? how does that work?

    It is always better to maintain H1 if you can as it reduces risk of going out of status upon denial of I-485.

    You dont automatically switch to EAD, to make the change you will file an updated I-9 to indicate the yyour work authorization comes due to EAD. After that you will need AP to reenter.

    If you change employers it can be done one of two ways

    1) transfer H1
    2) use EAD... the only thing to do is to state on I-9 that you are using EAD.
