Hi,
My I94 expires in mid February 2008 and so does my wife's EAD (I765).
I had applied for L1 petition extension which has been approved and the new I94s have been mailed by USCIS but i have not received them yet.
my wife will be travelling to INDIA on 17th November.
I have already e-filed her EAD renwal application. we just have to submit the copy of her new I94.
1.) Since my wife is leaving before i receive her extended I94 can i use the new I94 which i will receive and submit the documents to USCIS when she is not here?
2.) Should the applicant be in the US when submitting the I94 for proof of legal presence or is it just enough if she is present when creating the application on the USCIS site ?
