  • Full Time JOB Offer on EAD

    Hi Friends:
Please provide your input on my concern. As EAD is valid for one year only, and we have to keep on renewing.
If you get a full time job offer based on saying that you are eligible to work without sponsorship/H1B. Will not employer should have concern about the EAD expiration date, how can this concern of his be overcome or explained to them, that EAD keep on getting renewed.

Is it possible that they can deny the job because EAD is only valid for 1 year.

Please let me know if I was not able to explain clearly.

    Not a problem

Yes, the EAD needs to be renewed each year. The employer's only concern would be to make sure you provide the latest & then current EAD renewal confirmation for their files.

Any employer can and will give you a full time offer. Nope, the employer should not have any concerns that this needs to be renewed each year as long as you renew it.

If you fail to send the renewal confirmation the next year, then the employer has the rights to terminate your job, but otherwise there should not be any problem.

    Good luck.

      "Knowledgeable" thanks for the reply,

See my concern is not that I will not apply for renewal, what I'm concerned about is "what if does not get renewed" (for some or the other reason). Assuming such case happening probablitilty, being an employer why should I waste time, money, efforts on someone with EAD.

Do you think some employer may get this type of concern? (They will know about the expiration date, as soon as anyone of us fill I-9 form using EAD)

Not a serious issue for Rajesh2008

          Dear Rajesh2008,

It's not a very serious issue. Unless things have gone absolutely wrong or if you've committed a fraud or crime, there is no reason for your EAD not to be renewed each year.

Also, it may not be for a long time anyway, as once you get your GC, you're done!

If you want to be 1000% absolutely safe and careful, then it's a totally different thing.

Technically the employer is not supposed to be "concerned" due to the expiry of your EAD. If in a very rare case they are, then it won't be a good idea to work for such an employer, anyway!

          Take care.

PS: Sam1234 - You can change your job if you want to.

            Thanks again Knowledgeable,

I guess, I will just have to wait and see what happens and hope for the best.

Being in a situation similar to some of us (Family, no job etc.), after getting a job offer and if it get denied because of some stupid/nonstupid reason...you can understand what I'm saying or kind of a situation I'm in ...

But will just wait, watch & hope for the best

            Thanks a lot again

              Be always prepared

Always be prepared for such situations. You may already be managing this, but here goes, may be useful to someone else too.

The first thing is to have more than sufficient cash in the bank (money market account).

Live a little below your means, in other words, spend only what you need to and save the most.

As long as you have enough cash to survive for a while, you're safe.

Have an emergency backup plan, like possible outlook in your home country, moving to Canada, UK etc.

              Good luck.
