  • Have Job Offer but EAD hasn't arrived

    My wife (US citizen) sponsored me. I filed for EAD, advance parole and I-485 together Nov. 2007. Received date is Nov. 14th and Notice date is 21st.

    Now I got a job offer (and company wants me to join from 18th Feb) but my EAD hasn't arrived yet. My biometrics appointment is on Feb 13. I tried to go to USCIS and tried requesting interim EAD. They told me that they don't issue anymore and they won't do anything until 90 days are over.

    I called USCIS customer service and tried to request expedite processing and they agreed to start a request based on financial loss to company or individual grounds. They told me that local USCIS will contact within 5 days . Its been 3 days and I haven't received any call.

    1. Is EAD dependent on finger printing?
    2. Do they count 90 days from received date or notice date on I-765 receipt?
    3. Is there any way to expedite it now? And how long would it take?
    4. Is there a law that company can start him working on some conditional basis, like has to provide EAD in certain time?

    1. Is EAD dependent on finger printing? Not all that dependent, but they do use the picture you get at Biometrics.
    2. Do they count 90 days from received date or notice date on I-765 receipt? from the Received date on the I-765 receipt
    3. Is there any way to expedite it now? And how long would it take? There is no way. You already requested it, now you just have to wait.
    4. Is there a law that company can start him working on some conditional basis, like has to provide EAD in certain time? Yes. 3 days after being hired. I would recommend you to be patient. Everyone has to wait, so should you.
