Re-enter USA with AP?

Dear Madam/Sir,

I like you site very well. It provides lots of very helpful information to deal with any immigration/non-immigration issue. I just completed the preparation of documents for my parents' visit according to the information on your site. Now I have some questions about using the AP.

I got a RFE for my I-140 from USCIS, and the deadline of the response is March 10. I concurrently filed I-485 with my I-140, so that I got AP. I have to leave USA in March 20, and come back in March 31. I am a H-1B holder. If before my back, my I-140 gets denied, may I still be able to re-enter USA with the AP based on this I-485 concurrently filed with the possibly denied I-140?

If you are on H1, why don't you just enter back on H1? Read https://www.immihelp.com/maintaining-h-l-status-vs-using-ead-ap-after-filing-adjustment-of-status/

If your I-140 gets denied, it depends upon why it was denied.
