    Hi Members,

    Thank you for the replies on EAD and AP.

    My PERM was filed on Feb.22, 2008. Yet to be approved.

    I have valid H1B visa. And I need to travel to India for a week during the second week of April 2008.

    Will it be considered abandoning my GC processing, if I travel, while PERM is filed?

    Appreciate your answers.

    how many times are you going to ask the same question. The USCIS has allowed H and L visa holders special dispensation from requiring AP. Soo enjoy your vacation,. As long as you have the I-485 receipt and H visa stamed on passport you are fine.

      Probably I am unable to connect the points.

      My understanding of the GC is:
      1. Apply for PERM
      2. fill in I-140
      3. file I-485, which would not happen in my case and would looooong time.

      so PERM is not same as I-485. Where is the question of receipt of I-485, when I have just applied for PERM? that's where I fail to understand the procedures.

      But I understand your point of view: with a valid, active H1B, I could travel.

      Am I wrong?

        if you have not files I-485 then there is no question of abandoning anything. If you give partial facts then you get incorrect response.

        For labor(PERM) and I-140 you dont have to be in USA at all.
