Hi,
We (my wife and myself) have to urgently travel to India tomorrow for one week because of my parents critical health condition. I wanted to know if there will be any problem while going out and coming in to US.
I am on H1 and it is valid till Sept 08. My I-140 is not yet approved and I do not have the Advance parole document yet.
My wife converted her H4 visa to F1 visa in Sept 2007. Fortunately she has got her Advance parole which is valid till Jan 2009. Her F1 visa is not stamped on the passport.
1. According to my understanding I can use my H1 and my wife can user her Advance parole while going out and coming to US. But I want to confirm whether we are missing anything.
2. Even though my wife is using Advance Parole to come back to US, does she has to get F1 stamping in US Consulate in India. Our one week trip will be hectic, so we are trying to avoid this activity.
Please advise urgenlty.
