EAD and relocating to India

Hi Please help me with my query:

1. Me and my wife are currently in US and both have EAD/AP valid till dec 2008. I work she doesnt.

2. We are planning to relocate to India to an Indian firm.

How does it affect my green card process? After i move back to India, can we still renew EAD/AP from there? Do we have to visit US to do that?

Could someone clarify since i am totally in dark. Thanks.

If you are relocating to India, does that mean you are moving to live/work there permanently (or at least more than 2 years)?

If so, then you have a big problem. You seem to be abandoning your permanent residency application, even before is granted.

You can not relocate to another country, certainly NOT WORK in another country (with few exceptions) and still be a green card holder.

You can visit other countries, but can only be gone, until the AP is valid... you must use the AP to return to the USA before it expires...

This is a very BAD move... you can not renew AP or EAD while outside of the USA. You must come to the USA and renew them from here and it will take 60-120 days for you to receive them (and you must stay in the USA until you do so, specially the AP).

I say again, you can not relocate and work in India and be a green card holder.

Thanks for your reply. My PD is end of 2003, and getting a GC in near term is remote. Due to personal and family issues, i unfortunately cannot wait that long.

1. What are some of the alternatives / suggestions in my situation? My new position might require regular US visits. Is there exceptions i could file?

2. Worst case, if i have to abondon my I-485, what are the consequences in future?

1.- You will abandon your GC and have to apply for a B1 visa for business visits to the USA.

2.- Depends on what you mean, as far as immigration, well, it may be harder to obtain a visa next time.
