Please advice.
Little about me:
I'm on H1-B status and living in USA from past 7 years. I filed my green card under EB3 and my priority date is March'05. I've got my EAD and AP. I'm now eligible to change employers under ACT 21 as I my I485 case is pending more than 180 days.
Question:
Is there a way I can file a new labor(PERM) with my current or new employer under EB2 and still use my old EB3 priority date? If so do I need to file I-140 or just filing labor is good enough? Also important thing is to do all these do i need to be on H1B status or can I use EAD and still file labor under EB2 category?
Please let me know.
