    i received my ap in october & m planning 2 visit india on ap.i have received only 2 copies of ap.i ve seen lots of them receiving 3 copies.is it going 2 create any problem when i come back.should i ask uscis for my 3rd copy?please help.

    2 copies will allow you to leave the country twice

      it does not matter. For as long as you checked the box for "multiple trips" on your I-131 application you can use it for several trips.

      1 copy will be taken by the CBP officer at the POE for their records. The other copy will be stamped and given to you. You can re-use that remaining stamped copy to re-enter the USA as many times as you want, for as long as the AP document is not expired.

        Hi kaltaf21,

        Short Answer :- You are fine. The 2 copied of Parole you have received are sufficient. Same Parole can be used to enter the country multiple times. That's because when you come in, they stamp your Parole & they will give the copy back to you.

          Just wanted to share my experience with you all.

          My Route :- Bangalore to Washington Dulles International via Frankfurt.

          Date :- Came back into the US on April-7th-2008 on AP

          Experience :- When you get out of India, remember you do need to go through Immigration, so make sure you have a photocopy of the AP, just in case the Indian officer asks for it. The problem is, the officer may not be aware what a Parole is, all he can see is your expired H1 on your passport & he might raise the red-flag, but generally they know what an AP is & if they don't they can always check with other officers.

          Transit in Germany :- nobody checked my Passport or my AP. All they wanted was my boarding Pass.

          At Washington Dulles :- During the flight from Frankfurt to USA, you will be given a copy of I-94 & customs declaration forms to fill, do not fill any other form, I-94 is the one you need to fill, although it is a bit confusing for the Airline crew to determine which category you fall under..so just keep things simple & ask for I-94, leave items 10 & 11 blank on I-94

          At the Immigration, get into the non-citizens line & present you AP, once you do that you will be sent to a separate room, where they process AP cases (before you get into this room, they will let you to collect your baggage)

          During Processing, I was asked
          #1. How long were you out of the country?
          #2. How long you have worked for the Company?
          #3. where is the company located?

          They DID NOT take my finger-print OR my photo. Remember, the Immigration officer has COMPLETE access to your case on the USCIS database, so before they ask you anything, they already know what your answer will be, so be truthful, you cannot hide anything from them.

          When I left US, my finger-printing was not done, so if you are in the same boat, just ask a friend to check your mails regularly & if you get the notice while you are away, you can either cut-short your trip & come back OR contact your attorney from India & ask him postpone your finger-print appointment (remember, if you do this, your case might get pushed to the back of the queue, all the way to the back)

            AP Validity

            Currently I have only EAD and i did not bothered to apply for AP because my
            H1b is valid until June 2009.

            Can i apply for AP after the expiry of my H1b ?

            Also what is the validity of the AP ...One year?

              You can apply for AP anytime if you have a pending I485. If your H1b expires, you automatically fall into parolee authorized stay period however, to work you need EAD.

              Yes, AP is valid for 1 year from the date approved.
