    Got job offer/EAD pending

    Hi forum members,

    After a long struggle of 3 months, I have a job offer from an MNC in my own technology. Since I am in a mix of H1b/AOS status I applied for my job on my own while I am waiting for my EAD. My questions are

    1. Can I take an Infopass to find out the status of my EAD

    2.What are the other options that I have? Please suggest me. I can't write in words my struggle to get this job.

      1. Yes, if it has been more than 90 days that you have been waiting.
      2. No other option for the EAD. You can transfer your H1b to the dream job company and start work using AC21 if you are currently on H1b and in status. No point in waiting for the EAD.

        Received my EAD

        Hi Peers

        I had just received my ead (updated in on the USCIS website saying card production ordered) . Please help me clarify the below questions.

        1.Should I wait for 30 days for my card to be mailed ?(thats what web site says)

        2.Can I join my new job using approval status on the USCIS site and produce the card as soon as i get it. Is it legal?

        3.How do I handle my h1 employer now? will he know by himself?

        Please suggest.

          1.- Usually around 2 weeks.

          2.- No, you can not, you must show the EAD card.

          3.- Is your AOS based on employment or family?

              Then refile an I-9 with your employer using your EAD card.

                Thanks for the reply.

                1.In my case, this is my first job and I haven't filed my I-9 earlier. So once I file my I-9, will my H1B employer would come to know automatically?

                2.How do I let my H1B employer know about my EAD? Can he do anything odd to me legally since I didn't get a job through him?

                3. My Advance Parole (AP) is also approved and when we applied for it I had stated that I need to travel on the month of October 2008 as a reason for my AP. Can I still use my AP before October 2008?

                  So it is a different employer? ok.

                  1.- He wont find out.
                  2.- File an I-9 with them.
                  3.- You can use it for as long as it has not expired.

                    Thanks Buddy for your prompt replies.

                    1. Will my employer threaten me or can he do anything to me once he knows I had taken up a different job?

                    2. Can I use my AP to travel before october (I am asking this because I had stated in supporting document for AP, I need to travel only in october) and can I use AP if my job requires me to travel?

                    Thanks to all the forum members who responded to me with their answers and in particular to PraetorianXI who had always given me a helping hand.

                    Today I had my Infopass appointment to meet the Immigration officer and shared with her that,though my EAD being approved I havent still received it,but employer wants me to start work on Monday.

                    She was a very pleasant lady and she endorsed my document(I carried a status print out from the USCIS website saying EAD card production ordered) and she told me my card was posted on April 15th 2008 . She also stated that I can start work on the specified date and show my EAD to employer once I receive it (which should be in my hands in early next week). I want share this experience so that anyone in my similar situation can discuss with the IO.They were very pleasant and helpful.

                    Once again I thank the peers in this forum for their valuable Suggestions and replies.

                        If you are pending AOS (family based), there is nothing your employer can do to you. Once you start working on EAD, there is nothing the employer can do.

                        You can use AP, for as long as you return to the USA before the AP expires.
