I have a valid EAD and valid Advanced Payroll which will last thru my trip. My h4 got expired on 11th jan 2008. After coming back i have an immediate fulltime offer that i will be joining with my EAD.
Is my AP sufficient to travel back to US. Our I140 is still pending and so is our I485. Should that be a problem.
Since i stayed in US illegally after my h4 got expired some 90 days back will i be not allowed to step into US with my AP if i dont get my H4 stamped when in India.
I have planned my trip to india for 20th april from US and back on 10th may. I am travelling alone with an infant to attend my brother's marriage. I want to avoid any trips to consulate as the schedule is too tight. If asked by my future employer i might have to return back even early.
I would really appreciate a quick reply because if i have to get my visa stamped i need to start taking an appointment ASAP to make it in those 3 weeks of trip to India.
P.S.: In case i dont need a stamping and travel back with AP:
From the forums i came to know that with Advanced payroll checking would take more time so having enough time for connecting flights is better. Does that mean my 2 hour transit in kaulalumpur on the way back wouldnt be sufficient for boarding the next flight?[/B]
