  • Ead I9 Ac21

    Hello Group,
Please help me if someone has a similar experience. I still have three years left on my h1b and I am changing the employer on EAD( The new employer is not ready for H1b transfer- saying they ran out of their H1B quota)
The job title as mentioned in the labour certification is changing but the job will remain similar.
Am I carrying risk changing job on EAD..i also have a derivative with me.
Moreover what is this I9 form. I understand that is not to be submitted to uscis but kept by the employers for inspection by DHS.
Who is responsible for filing AC21. Does it need to be filed.

No one can predict the risk for using AC21 and switching employers. If job is similar, it should not be a problem in general. I9 is employment eligibility form and paperwork that goes with it is for employers to ensure they are not hiring anyone illegally. There is no formal paperwork to file for AC21 but it is recommended that USCIS be informed about your change in employer. Look on the forum for what to send to USCIS or you can hire the services of an attorney.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
