How long can you stay out of the country if you use your AP to go out of USA? can one be out for the whole year and come back before the time AP expires back in the US and then file for a new AP?

Errr. You do not use AP to leave the USA, you use it to return... so in that case, you must use it to apply for re-entry while it is valid (not expired).Disclaimer: The information you obtain from me at this forum is not, nor is it intended to be, legal advice. My wife and I are traveling to India from June 12th to July 7th. We have EAD and AP valid until September 2008. However, our visas (H1B - mine, H4 - her's) have expired in April 2008. Do we need to go for stamping in India to return to USA? Or Is AP sufficient for our return? Please let us know.
