  • H4/H1Petition Approved/EAD

My wife came to US on H4 (citizenship - india). A Houston based software company, applied for her H-1 in April 07, and in the lottery she got an approval. Last year July, when visa bulletin became current, my company applied for 485/EADs. My wife and myself both got our EADs in Aug 07.
She worked on a short project on her EAD for 2months (Nov 07-Dec07) for a different company (had nothing to do with the company that filed her petition). The houston based software company couriered her approved H1 petition notice only in Dec 07.
Recently, they called and we told them about the EAD. Her software company wasn't very nice and talked about cancelling/revoking her H1. Frankly, they were trying bully around in general terms about her legal status.
They have been very indifferent in the past. Hence, we don't want to have any relation with this company nor are we interested in the H1.
    My questions:
    1. Should we care about the h1 petition being cancelled/revoked (I don't even know what it means - if you can explain, that would be great).
    2. Any word of advice - anything we need to worry about in short term and in long term?

    thanks in advance!!

If her 485 was filed before the H1b kick in date of Oct 1st, she is in valid status or authorized period of stay by the attorney general since then.

H1b COS has no impact on her status. On the other hand if the 485 was not pending for her, she would have been out of legal status by not working for the H1b sponsor.

Chill, she is a parolee now and has nothing to do with the H1b. Tell them to go take a hike.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
