  • on H-1B, should I file EAD?

    - I am on H1-B.
    - My PERM was done last August and my employer filed my I-140, I-485. I-140 is not yet approved.
    - Employer also filed for my wife's EAD last August. Spouse has received the EAD card. I have not applied for an EAD.

    Question:
    1) What steps should be taken if I want to change employers?
    2) Is filing EAD for myself a must if I want to change employers?

    1. Wait until I140 gets approved.
    2. You can change employers on H1b or EAD. Key is to notify USCIS about the change in permanent employer and to ensure the job is in same/similar category as what the GC was filed for.
