  • EAD E-file Question...plzz help

    Hello friends
    I am currently trying to E-file my wife's EAD Renewal application. Both mine and my wife's I-485 is currently pending in Texas Service center. Also, my I-140 is also pending in TSC since August 31,2007. Cutoff date-Sep'2006
    I am still maintaining my H1B status, but my wife worked for a month last year and used her EAD. My understanding is that she is no longer on H4 status.
    In the E-file for Renewal EAD, under Current Immigration Status: What should i indicate???
    It does not give me an option for Pending Adjustment of Status or EAD.
    The other options (that are close to her status) i see are
    1) H4 visa (wife of H1 thru H3);
    2) EAO (Employment Advisory Option)---I frankly dont know what it means???
    3) Parolee

    Which option should i choose......senior members.....please help...

    Thanks

    Pending I485 means Parolee as she has used her EAD in the past.

      Is she a parolee eventhough she never used AP?
      Her latest I-94 (Nov '07) shows she is on H4 visa. Since she started working just few months back.
      Thanks for your quick response.

        What was her last action? Entry on H4 or use of EAD? Use of EAD constitutes giving up non-immigrant status of H4 and being on Parole. It does not need to happen only due to AP.

        This should help.
