    Hi,

    Details are
    L1 Visa expec 2008
    L1 I-94 exp ec 2010
    L2 Visa,EAD,I-94 expec 2008
    Please suggest what options available to renew the EAD .

    1.Can we get the EAD renewed based on L2 I-94.
    2.Is it possible to get I-94 extended based on the L1 I-94.

    Please suggest best option so that EAD can be renewed before it gets expired.

    1. Whay was the L2 not extended with the L1? You should immediately file for L2 extension of stay and once that is approved, EAD can be renewed.
    2. Yes, I-94 for L2 can be extended based on L1 extension. Form I539. EAD happens after this is approved.

    Quick option would be for L2 go outside US, re-enter, get a I-94 till 2010 based on L1 approval, file for EAD extension.

      Thanks for response . I feel option 2 could be good but L1 visa is expring in Dec08 but L1 i-94 is valid till Dec2010 .So based on my (L1) I-94 they will extend her (L2) stay? If yes then what would extend L2 visa or L2 I-94 . Which can be used to extend the EAD Please suggest.

        Visa is different from a petition which comes with an attached I-94 if extension of stay is approved. All extensions for dependents inside US are for the I-94 based on petitions. Generally, both L1,L2 extensions are filed together. Apparently, it was not done for your case for some reason.

        Your visa is just an entry document and isn't significant after you enter through the POE. All that matters thereon is the I-94 expiry. Visa extensions are not possible inside the US.

        L2 extension is possible based on your already approved L1 petition+I-94.
