EAD and getting married.

Hello All,

Please try to answer my question.....

Does your status change when you receive an EAD card (category C9)?

I'm currently on an H1B visa and soon to be married. The plan was for my wife to come down on an H4 visa attached to my H1, but I'm wondering if she can still get an H4 attached to my visa if I now have an EAD.

Just getting the EAD will not put you on as a parolee. But if you use the EAD or use AP to enter, then you are a parolee and can no longer bring in a dependent on H4.

It is important that you maintain your H1b status at all times for your spouse to be in valid status.
