    Hi,

    Any body has any idea on switching from H1 to EAD from one employer to other. Like Iam with Employer A on H1 and want to switch to Employer B on EAD what happens to the medical insurance during switching. Like if I leave the employer A today and I join employer B on EAD aftere a week, in between how is my status and medical insurance.

    I appreciate if any body give an advise/suggestion

    You need to check with your employer A as to when they end the medical coverage and employer B when they start the coverage.

    Some employers continue coverage till the last day of the month and some terminate it on the midnight of the day you resign. You can also talk to them if they provide COBRA coverage.

    New employers also have start dates like the first of the month following your joining or the day you join. This is a HR question that can be best answered by your company folks.

    As far as your status goes, the day you quit your H1b, you become a parolee as you have no other non-immigrant status.

      Shifting H1 to EAD

      Hi,

      Instead of me resigning if employer terminates me and I have EAD, 140 cleared more than 10 months back and if there is a lag in choosing new employer what happens to my status.


      May be this is rate but there is a chance.

        Nothing happens. You become a parolee. As simple as that. You need to be in a similar job and file AC21 request to change the GC sponsor to the new company.

          If I become Parolee I no need to tied to employer? after leaving the current employer how long I can stay without an employer taking the situation I did not get job for some time , may be couple of weeks (? dont know) in this the risk is being no medical insurance since Iam not with any employer or any other risks.

          I beleive being with another employer asap is a good thing but if it takes time what are the consequences.

          It shows me I dont have clear understanding what parolee is.

          I appreciate if you throw some light on this.

            If you have applied for a I1485 and not maintaining any other non-immigrant status, then you are a parolee. You can read more on immihelp mainpage.

            You need to have a job in similar category as what your labor and I140 were approved for if you are using AC21 and switching employers. In a nutshell, it means you are changing your permanent employer to your new employer.

            You need to have a job by the time your PD becomes approvable. It is always safe to have a job but not a big deal if there are small gaps.
