  • EAD with unapproved I-140

    Hi,
I got my EAD on in Nov 2007.
My I-140 is still not approved.

Now, I want to change my employer.

It has been more than 180 days after I-485 receipt and EAD and I-140 receipt.

My question is, if I change my employer now will it affect the green card process at all?

If it will not, is it compulsory that I should be on the EAD for the new job or would it be Ok if I did a H1-B transfer to the new company?

Also, other than the AC-21 is there any other document I need to file?

    Thank You
    RC

You can transfer the H1b or use EAD. In either case, if the I140 has an RFE or denial, the employer may not respond thereby resulting in a denial. It is NOT safe to switch without the I140 approved and use AC21. You might be forced to restart the whole GC process again.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
