    Hi

    I'm on a L1A visa currently. My spouse will be on a L2. I was thinking of incorporating a LLC. What I plan to do is own that company, and have my spouse apply for a EAD and work for me (I understand that having a L1A visa does not entitle me to work for any other company even though it's my own).

    Will this be legal or not? If not, can you point me to why? From what I've read, this should ok (Unless I've missed something).

    Who else will be running your company? You can form a company but cannot run it or work for it or have anything to do with the day to day operations.

      oh wow. didn't know about not be able to run my own company. what about my wife? can she run it? she can be designated as "manager" as per LLC definition.

        You do have an option ...

        ... if you invest at least 1 Million US dollars in a company and hire minimum of 10 US residents or citizens then things are different for you.

        You can even get your own permanent residency through this process, expedited!

        If this is not an option you can work with, then you're out of luck.

          god dang it... why is it so hard to do? don't IRS want the tax revenue from this? geez. i guess i'll have to keep my fingers crossed on that lottery jackpot!

            Yeah, you got that right!

            ... you may also consider S-Corp.

            If you're very serious to start a company sooner or later and have the time, call up the IRS or go to their web site.

            They'll be glad to send you tons of documentations and CDs on how to start a company, actually flooding you with lots of information and knowledge.

            Once you go through this and have done your homework, then contact a senior CPA and start your company properly.

            You can surely think of a few names now itself, as not all names may be acceptable to your state when you register your corporation.

            Also, you can consider purchasing your domain name and make sure you get all the COM, NET, ORG as well as US.
