Need suggesion about changing employer eventhough 140 had been approved on Jan 30th,

    Hi,

    I have got my EAD while my I-485 is in progress and can get it at any time, but I have not used my EAD so far.

    I am still using my H1B, I have got too many layers ..The company I am working as contractor, A ( Which I am working with client) company will pay to B company as 80 $/hour, B company to C company as 60/Hour, C company pays to D company as 45$/hour, Now D company in which my H1 is holding and same company had process my Greencard( I-140 had been approved on Jan, 30th this year) which pays to me as 35$/Hour.

    Now, Is that If I get rid off my current employer and work with EAD instead of H1B ..Is that possible or Is there any restrictions with my current employer ..

    I need any body suggestions ..I will appreciate your help.

    Leaving the issue of non-compete agreements with the employers/vendors/layes in between, you can use AC21 to change to same/similar jobs after the 485 is pending for 180 days and much safely if you have the I140 approved. Read about that and you will know more.

    In layman terms, you are telling USCIS that your permanent job employer (GC sponsor) is changing from X to Y and you intend to work for them on a permanent basis (definition of GC)

      Thank you for this infor ...My I140 had approved ..its almost more than 180 days .
