  • New Employment - EAD, AP, H-1B Questions.

    Hello,

    My current Status is
    *I-140 - Approved from "Employer A"
*EAD - Received for 3 years along with my wife, from "Employer A"
    *H-1B - Received for 3 years, from "Employer A"
**Wife has seperate h-1b with another company

    Questions
    1. There is a new job for me, where the new employer B is ready to transfer my H-1B and equally I plan to continue by EAD - Is this OK ? Any issues from your experience or knowledge ?

    2. My understanding is that I'd quit Employer A, but preferrably continue with the same immigration firm for EAD and AP while I take up my new job - Any issues or can you suggest from your experience or knowledge ?

    3. On docs, I've all above mentioned in originals, "except" I-140, which I understand would be with the employer ( in my case Employer A ) - Anything else I should have or good to have ?

    Thanks much !
    Arun.

How did you get your 3 year EAD? On what basis?

    1. What do you mean by "Equally I plan to continue by EAD"???

    2. What is your basis here? Are you using AC21 to switch your permanent residence sponsor to the new employer? If it is your lawyer, then no issues. If it is the employer's lawyer, not a good idea.

    3. Not sure what you are talking here.

Your post is very confusing and I could not understand most of it. Need a clear post to be able to help otherwise contact an attorney.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

      >>That's the new law I heard, don't know. You could know more.

      1. What do you mean by "Equally I plan to continue by EAD"???
      >>That is, I plan to transfer my h1-b and not move to the job, using my EAD.

      2. What is your basis here? Are you using AC21 to switch your permanent residence sponsor to the new employer? If it is your lawyer, then no issues. If it is the employer's lawyer, not a good idea.
      >>That is part of the question - while I plan to transfer my h1-b, I'd like to know what needs to be on the EAD side ?

Then the associated question is as what I can do, with my attorney ( not old/new employer's immigration firm ) - as I heard that I could quit employer A and talk to their firm about availing their services to continue my EAD and the rest of the paper work, until I get green card. I'm not sure how this would work out - any guidance would be very helpful.

You have to look into AC21 memo and guidance. Immihelp home page is a good place to start your research.
