The current sitiation is as follows:
I'm on H1 since Early 2005 and my wife on H4 since early 2007.
I have a Pending I-140 filed in June 2007 and pending I-485's for me and my wife filed in July 2007. I also filed for EAD and AP for both me and my wife in Jul'07 and it got approved. Both EAD's expire mid-december'08.
My wife traveled to india in feb'08 and returned in March'08 on the approved AP.
In Aug'08, she got a job and is now working, based on her EAD and filled the I-9 form with her employer.
Her EAD expires in a little over 2 months and from what I understand she can't legally work after it expires and till she gets her renewal EAD.
Here's my Question:
While filling out the I-765/I-131 forms via "efile", there are 2 questions I can't figure out.
1. What was the status she last enterd the US on? ... and ...
2. What is her current Immigration status?
If I were to complete and mail this form via us postage, then I'd directly write AP for the first question ... and EAD for the second question.
Since i'm doing this via efile, both the questions have a drop-down list that you have to choose the appropriate catagory from.
(a) For the catagory of AP, I see "DA: Advance Parol (District Auth.)"
Is that the correct option?
(b) For the second question, there is no catagory which explicitly states "EAD" or "Employment Authorization Card". What should I select?
Since her EAD expiers Mid Dec'08, I need to file for her EAD asap.
Any help will be appritiated.
