    Can someone please help me -
    I am on H1 and my EAD has expired last month. Can I change employer on H1 with AC21? or I have to have EAD?

    You need to be clear on what you mean by change employer on H1b and AC21.

    You can transfer the H1b and use AC21 to begin work immediately. If it is for your green card, you can still do the same. If you don't want the H1b transfer to the new employer, you would need EAD to work.

      I did apply EAD/AP/I485 in Aug 07 and my EAD has expired. Now I want to transfer the H1B since I don't have EAD. I think as per your response, I can transfer H1B with AC21 to start new job.

        Yes. There are two parts for AC21.

        One involving H1b portability that allows you to work after applying for the transfer.

        Two, for changing your GC sponsor to the new employer. The requirements for this have to be looked at carefully as the job has to be same/similar.

          Would the salary matters?

          If you use EAD and AC21 then do need you to have same amount of salary?

            Salary is not a primary requirement. Job profile is important. Everyone knows a programmer in Texas making 75k will make 100k in California.

              Thanks txh1b for your help. So no need to apply EAD in that case. Can save some money if work on H1B.
              Wondering why lot of people apply for EAD if they have H1B validity and their spouse doesn't work.
