  • EAD and Payroll

    Hi,

Can you be without running your payroll while working on EAD for any reason, let us say to take care of the baby at home, etc?
(And let us say this happens with the same employer with whom you have filed your GC and with whom you have used your EAD to run your payroll. )

If so, how long is it allowed? I am the primary applicant of my GC process.

    Thanks,

Use of EAD means you are a parolee and no H1b resptrictions apply. You need to prove you have a job at all the times and can take off for any reason without pay.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

      Hi,

Thanks so much for the reply. If you can take off for any reason, is there any maximum time that you can't be without a payroll? For example, if you are on H1B, the bench period is allowed for 6 months. Likewise, can you please tell me in the case of EAD usage?

Where did you get that info from? There is ZERO room for bench period on a H1b.

          Hi,

Thanks for correcting me. I am not sure how I got that info, but I hear very often from lot of people about the bench period while you are on H1b.

But, my question is about taking off without running payroll when you are using EAD and being a primary applicant. If you can take off for a while for any kind of (domestic or medical) reason, (I am not sure what is allowed legally) I would like to know the maximum time it is allowed legally.

Thanks in advance for your answer,

If you are called for a GC interview, you need to have a job similar to the one the labor was approved for as a parolee. That is the requirement. Rest is all common sense and situation based.
