if a person in EAD loses job...

If a person working on EAD (and H1 became void when he changed employer) loses job, can he stay in USA without a job for a month or so? is it legally permissible?

Provided your basis for EAD is still valid like your GC is pending. You would need to use AC21 and get on a same/similar job ASAP in case you get a GC interview, that is crucial for approval.
