My I-765 application got denied in dec 2 2008.I had a motion to reopen a decision I-290B ,but got denied also.Now iam trying to go for the comissioner(because i beleve the decision was wrong).Do you know please how to do this ? Do i have to file an application for this(if yes what is the application form for the comissioner) or do i have to call USCIS customer service . Please if you have any idea,let me know.

Thank you for replying.
It was denied because USCIS sent to me a document on march 2008.I wait the 30 days but i did not receive that document. I tried my best by calling customer service 7 times and having 4 times INFO PASS,but no information available.
On december 2008 ,USCIS sent to me a denial notice for I-765 explaining to me that the reason for the denial notice is because USCIS issued a request for evidence (I-94 document)on march 2008 but i failed to respond.
Dec12 2008,i filed a motion to reopen a decision I-290B and i explain to them that i did not receive any document from USCIS before Dec 2 2008 .
Jan 13 2008,USCIS sent to me a denial notice again saying the folowing:"In the motion,you the applicant state that you never received any documentatin from our office requesting additional information and/or reasons for the denial of your application.Therefore,you are requesting reconsideration of the service decision on your application.
The service has concluded that your claim contrdicts the proper action of the office.You have failed to establish that the denial of your petition was a service error."
The officer at USCIS miss understood by telling me that i contradicted the proper action of the office because i said that i did not receive any document before DECEMBER 2 2008,not any time.
last thing i want to mention also that i did provide USCIS with a I-94 and a copy of my passport (For request for evidence because failure to register on NSEERS)before march 2008 and that was in october 2007.
praetorianXI please if you know,tell me how to go for the commissioner? and is it goood or no?
