My Husband and I are H visa holders - he is the H1b visa holder and I am H4. We have both got pending I485s and I used my Ead for a short while. I have applied for Advance parole but beacuse my husband has still a valid and current H1B visa do we need to file one for him. We are both travelling in March, my other question is what if you have to travel for an emergency and your AP is noy here yet??

1. I believe you still need to apply for Advance parole is you applied for 485. If you do not than it is presumed that you have abandoned your 485.

2. Once you sent in your application you can leave. CIS can also send it to the consulate for you to pick up there. I believe you just need to make sure you have them when you come back.
