  • EAD Denied - Reapplied

    Hi Everyone,

I am on L2. I have been trying to get my EAD done. It was denied once.

I had efiled last time - got Biometrics appointment - waited -waited - 5 months with website showin no change in status. Later when I called up for an Info Pass appointment, within 3 days I got a denial notice. The reason given was that USCIS had sent Request for Evidence and we did not reply.

We never got any such mail. We get all other mails from USCIS except this one which they said they had sent. There was no way of fighting or arguing with them. The options to reconsider or reopen were 565$ so we re applied.

This time we applied via normal mail with tracking number. The application reached fine.

    Application notice date - 02/12/09
Our check was en cashed on 02/17/09

We have still (as 02/14/09) not received any mails for biometrics. I am worried that it will again be the "Lost in mail - You did not attend biometrics appointment" story...

Does any one have any similar experiences that they have to share?

Any suggestions on what precautions I can take so that i do not end up wasting 340$ again? It is very frustrating ...

Do I have to go for Biometrics again? they have the details from last time.. I had mentioned in the second time application form about the denial and also sent the copy of first times documents.

Is there anything we can do about USPS dropping/returning/loosing mails? I have double checked my name on the mail box. I get all other mails fine. Even SSN.

    Wow,
that's a difficult experience, my only advice to you would be to sign up for USCIS email updates on their website

    AND --
If you have your receipt no. you can check your status online and they will tell you if they have sent you any correspondence by mail:

View case status online using your receipt number, which can be found on notices that you may have received from USCIS. Also, sign up for Case Status Online to: . Receive automatic case status updates by email or text message, . View your case history and upcoming case activities, . Check the status of multiple cases and inquiries that you may have submitted to USCIS

They will email you as soon as they have mailed any notice which will allow you to keep a look out for it and if nothing turns up you can then contact them (BY PHONE) in the early to let them know that the letter was not received, hopefully they will then send you a second notice I'm not sure and I doubt they will give you more time to respond but at least you would have been able to contact them in due time and get the info you need.

    Hope this was helpful,
