  • H1 Job Loss -what next wrt USCIS

    Hello,

    Advice on what needs to be done with USCIS, if any, from my side:

    Background:
    - we (self & wife) have H1/H4 visa resptively and I-94 based on it valid till Nov 18 2009.
    - we have a valid EAD/AP till 10/2010 but not used it so far
    - I140 is approved
    - Our employment based I485 is pending from more than 180 days
    - My employer is laying me off and will be terminated in next 2 days
    - H1B FAQ in immihelp say that we will be out of status the moment I lose my job.

    With the above background the following questions comes to my mind
    - Do I need to file any change of status application to continue to live in US and find another job
    - Can I just stay here based on my EAD. If so is there any notification to be sent to USCIS?
    - How soon I need to find another employer?
    - is it harmful or damaging to our pending I485 if we are without job for sometime while searching for another job.
    - if we travel outside us do we have to use our Advance Parole to re-enter US? Any downside on using AP (many people suggest not to use AP) Any issues or serious complications?
    - My company lawyers are having my original I140 and I485 receipt notices. Do I need to collect it from them? Can they refuse to give it if I ask for it?
    - Any notification I have to send to USCIS because of this layoff in my case?
