Is that job permanent in nature? If so, AC21 can be used. Talk to your attorney to look into the details.

You can go with any attorney if you have a copy of your labor filing to determine AC21 usage and how it seems fit.
Be aware that State employment departments may not provide the zillion documents that USCIS may ask for with RFEs. On the brighter side, USCIS may not bother to ask for those as the job is for the State.
