I140 approved can i get my ead

Hello,

My I140 is approved today but PD is not current. Mine is EB3 category.

My spouse is on H4. My lawyer is applying for I485 for both of us.

Is there any other form to file for getting EAD? How much time will it take to get EAD?

I maybe wrong but as far as I know, AP and EAD can be filed concurrently with I-485 for you and your wife (and children if there'a any). However, I-485cannot be filed unless your PD is current.

My EAD and AP arrived 2 months after it was filed. This processing time varies however.

If PD is not current, you can neither file for 485 nor EAD/AP.
