    I and my family are looking to visit India. I and my spouse have EAD and Advance Parole document (approved till November 2010) and my I-485 is under processing status. My I-485 was filed in July 2007. I although have H-1B approval notice (expiry August 2010) but my passport does not have current H1B visa stamp.

    Can I enter United States back with the help of the following documents only:

    1. EAD and Advance Parole
    2. Passport without current H1B visa stamp

    Do I still need to get H1B visa stamp on my passport for re-entry to United States?

    Please advice.

    If your 485 is pending you can enter using AP or H/L visa. But note that your status changes to Parole.

    There are many forums in which people recommend once you use AP for entering US you should always maintain a valid AP.

        Prashant,

        Were you able to get in without the visa stamp on your passport? I have a new passport issued in Houston without the H1B stamp. I do have my AP and EAD with me. Do I need to get my old passport with the expired H1B visa?
