  • Advance Parole in case of emergency

I am currently in the process of the 1-485 - accepted, biometrics appointment scheduled in 2 weeks, etc. I applied for the AOS and EAD but not the AP as I didn't see the need. Now I have an emergency situation (the death of my father) and need to return to the UK as soon as possible. There are no local offices (in my state or neighboring states) that accept the AP paperwork in person.

How can I get an AP or any other way to travel in this situation? I do not want to jeopardize my AOS process but I need to leave within the next week if possible.

    Can anyone help here?

You can go to a local USCIS office near you (need not be listed to accept AP) produce documentary evidence of the emergency and they could issue a emergency AP.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Thank you for the response. I just made an appointment for tomorrow morning at the local USCIS office and am gathering the paperwork now.
