  • Left US with expired EAD, hoping to return for Interview scheduled in 6 days

    Hello,

I am wondering if anyone has been in the boat: we left the US with my husband's expired EAD card. He had applied for a renewal 2 months prior to leaving but at the time we did not know it would take 5-7 months to get the renewal. We decided to leave anyway. We have been out of the country for the whole time waiting for the card and planning on having someone send it to us. It has not arrived and our interview is scheduled in 6 days. We went to the Embassy in the country we are in and they told us to go to a port of entry and ask to be readmitted. He seemed to think our chances of re-entry would be good, since we are a family, (Since applying for AOS we have a had baby who is now 1, that's how long this is taking!) and we have an interview scheduled. Also, our attorney did not get a notice that we left and that our application was abandoned like he did for another one of his clients who left BEFORE he received his EAD.

I know we should not have left but that is water under the bridge. Let's just get past that and NOT comment about it.

My question is, has anyone left and come back with an expired EAD? and what happened?
    Thanks in advance!

OP joined 3/30 and last login was 3/30, I hope they made it back to USA and were able to the interview.

For others reading this, please return before your AP expiration date and don't expect your renewal to be ready on time.

          Hi all,

Yes we made it back in via a land port. No, they were not happy but after making us wait several hours and taking fingerprints several times, they gave a note for parole for one day only. Upon receipt of it the officer said, you can go back to the US but never leave again.
We also made it to our interview and everything seemed to go fine.
None of this would have happened if the processing times weren't so protracted. A couple of years ago, a case like ours would have taken 6-9 months at the most. Now, it's 11-33 months. They need to extend the validity of the EAD card if they are going to extend the case processing times. It's simple math.
          Good luck to all.

Thank you for updating the information.

My guess is that the first step was made 11/01/2018 with the I-693 (now valid for 2 years), I hope they follow with EAD/AP. It is just wrong that people start renewing almost 6 months before expiration and some don't get the card in time for the 180 day extension (and they can't travel during the 180 day work extension). Having to process less EADs will help them a lot to use their time for other things.
