  • as F1 to marriage greencard, how to expedite EAD

    Hi! I am a F1 student who recently received a teaching job offer at a university, supposed to start in late August. However, I am a bit late with my AOS and just sent out the concurrent filing now.
    As an F1 student, I cannot use financial hardship to individual as the reason for expedition, as F1 is supposed to be able to support themselves during study;
    so, can I instead argue for financial loss to the company? (The new university expect me to teach multiple classes every semester and it is not easy for them to find a replacement teacher quickly), I haven't seen much discussion about this situation anywhere else so would like to get your thoughts.
    In addition, since the university is a not-for-profit organization, should I instead use the third reason "Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States"?
    I am so confused and anxious...Any advice/experience is appreciated. Thank you!

    Why don't you file for OPT? That gives you at least a year of work authorization while getting waiting for the green card process to play out. If you apply now, that should give you about 3-4 months to hopefully receive your OPT EAD.

    Why don't you just ask the university to apply for your work permit? They can use premium processing and you should get your EAD within two weeks of applying

      hopeful_pro thanks for your reply! Unfortunately I already submitted my marriage-based green card application, so these two options you mentioned is not possible now. The university cannot offer premium processing as this is a one year job that does not sponsor H1b, and I didn't chose OPT as at that time, I was under the impression that I can expedite EAD through c9, but expedite through OPT is suggested by my OISS advisor as not useful...

        Are you sure about that? I read online and was told by an attorney that OPT and AOS are two different immigration benefits you are applying for, so one shouldn't interfere with the other.. Not legal advice by any means but the comments probably are valid.
